The following key reforms came into force in FY24/25 and are now active:

  • Fair Work Legislation Amendment (Closing Loopholes No. 2) Act 2024 (Cth)New definition of ‘employee’ vs ‘contractor’
  • Modern Slavery Act 2018 (Cth)Updated reporting requirements and expanded risk focus
  • Criminal Code and Workplace Health and Safety Acts (State/Territory-based)New industrial manslaughter offences and expanded liability
  • Privacy Act 1988 (Cth)Initial reform stage: stronger data handling and breach response requirements
  • Consumer Data Right (CDR)Expansion into new sectors and increased data access rules
  • Australian Competition and Consumer Act 2010 (Cth)Enhanced penalties for price gouging and market misconduct

Legislation coming into force in FY25/26 includes:

  • Fair Work Legislation Amendment (Closing Loopholes No. 2) Act 2024 (Cth)Right to Disconnect provisions (26 August 2025 for small businesses)
  • Corporations Act 2001 (Cth) – new provisions via Treasury Laws Amendment (Financial Market Infrastructure and Other Measures) Bill 2024Mandatory Climate-Related Financial Disclosures
  • Australian Securities and Investments Commission Act 2001 (Cth)Climate Disclosures (ESG Reporting) oversight and requirements
  • Australian Consumer LawNew deceptive conduct enforcement powers relating to greenwashing and sustainability claims
  • Fair Work Act 2009 (Cth)Casual employment conversion reforms impacting employer obligations.

Many of these reforms apply across all organisations—but some are specific to certain industries or business sizes. For example, modern slavery reporting obligations apply to larger entities over a set revenue threshold, while mandatory climate-related disclosures target particular sectors and listed companies.

That said, every team has a role to play in staying compliant:
