Safetrac Content Policy

Client-Provided Content

1. Ownership: Clients retain full ownership of all content they provide for the creation of online courses, including text, images, videos, and other media.
2. Responsibility: Clients are responsible for ensuring that their content does not infringe on any third-party intellectual property rights and complies with all relevant laws and regulations.
3. Usage Rights: By providing content to Safetrac, clients grant us a non-exclusive, royalty-free license to use, modify, and incorporate their content into the online courses for the purposes of design and delivery.

Safetrac Design Elements

1. Intellectual Property: All design elements created by Safetrac, including but not limited to graphics, templates, course structures, and user interface designs, are the intellectual property of Safetrac.
2. Usage Limitations: Clients are granted a non-transferable, non-exclusive license to use Safetrac’s design elements solely for the purpose of delivering the online courses created by Safetrac. These design elements may not be used independently or in conjunction with other content not provided by Safetrac.
3. Prohibited Actions: Clients may not reproduce, distribute, or create derivative works from Safetrac’s design elements without explicit written permission from Safetrac.

Joint Content

1. Combined Works: The online courses produced using both client-provided content and Safetrac’s design elements are considered combined works. Clients retain ownership of their content, while Safetrac retains ownership of its design elements.
2. Distribution Rights: Clients are allowed to distribute the final online courses within their organisation or to their intended audience. Any distribution beyond this scope requires prior approval from Safetrac.

Modifications and Updates

1. Course Updates: Safetrac may update the design elements from time to time to enhance functionality, comply with legal requirements, or improve user experience. Clients will be notified of significant changes.
2. Content Updates: Clients are responsible for updating their content to ensure accuracy and relevance. Safetrac can assist with incorporating these updates upon request.

Termination and Withdrawal

1. Termination of Agreement: Upon termination of the agreement, the client’s right to use Safetrac’s design elements ceases immediately. Clients must discontinue use of any courses containing Safetrac’s design elements unless otherwise agreed upon in writing.
2. Content Withdrawal: Clients may request the withdrawal of their content from the online courses. Safetrac will comply with such requests within a reasonable timeframe but may retain archival copies for legal or compliance purposes.

Client-Provided Content

Any disputes arising from the use of client-provided content and Safetrac’s design elements will be resolved through mediation or arbitration in accordance with the applicable laws.
