New whistleblower law takes effect

New whistleblower laws to take effect on 1 July

The new whistleblower provisions under the Treasury Laws Amendment (Enhancing Whistleblower Protections) Act 2019 (Act) will take effect on 1 July 2019.

Although the requirement to have a compliant policy for public and large proprietary companies takes effect six months later, on 1 January 2020, employers must comply with the Act from commencement.

Therefore, ideally employers will want a compliant whistleblowing policy in place from the date the Act commences on 1 July 2019 or, failing that, at least some way of dealing with complaints so they do not breach the Act.

ASIC Commissioner, John Price, recommends companies train their staff in whistleblowing. The training should cover three key areas: how to raise a concern, how staff will be protected, and how the concern will be dealt with.
